Fifth Circuit Court of Appeals Vacates Texas CIS License

In a victory for advocates of nuclear responsibility, the United States Fifth Circuit Court of Appeals has issued an opinion vacating the NRC license for the proposed consolidated interim storage (CIS) site for spent nuclear fuel in Andrews County, Texas. The ruling was unambiguous: “The Atomic Energy Act does not confer on the [Nuclear Regulatory] Commission the broad authority it claims to issue licenses for private parties to store spent nuclear fuel away-from-the-reactor.”
